1. Acceptance
By using Every Single Session ("ESS", "the app"), you agree to these terms. If you do not agree, do not use the app.
2. The service
ESS is a workout tracking application that lets you log exercises, track progress, create routines, and analyze your training. The app is provided "as is" and we may update, modify, or discontinue features at any time.
3. Your account
- You must provide a valid email address to create an account.
- You are responsible for keeping your login credentials secure.
- You must be at least 16 years old to use ESS.
- One person per account. Do not share your account with others.
4. Your data
You own your workout data. You can export it at any time in CSV or JSON format. You can delete your account and all associated data at any time from the Profile screen. See our Privacy Policy for details on how we handle your data.
5. Acceptable use
You agree not to:
- Use the app for any unlawful purpose.
- Attempt to access other users' data or accounts.
- Reverse engineer, decompile, or tamper with the app.
- Use automated tools to scrape or interact with the service.
6. Fitness disclaimer
ESS is a tracking tool, not a medical or fitness advisor. The app does not provide medical advice, diagnoses, or treatment plans. Always consult a qualified professional before starting a new exercise program. You exercise at your own risk.
7. Limitation of liability
To the maximum extent permitted by law, Babylon Optima shall not be liable for any indirect, incidental, or consequential damages arising from your use of ESS. This includes but is not limited to data loss, injuries, or business interruption.
8. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be permanently deleted.
9. Changes to these terms
We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the new terms.
10. Governing law
These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
